A 26-year-old Birmingham man who police said shot two men, one fatally, after they stole his car Monday has been charged with capital murder and attempted murder, Birmingham police said Tuesday.

Brandon Mason was being held at Jefferson County Jail Tuesday night without bond on the capital murder charge. The attempted murder charge carries a $50,000 bond.

Meanwhile, two of the four men Mason saw jump-starting his 1985 Buick Regal with a stolen van - Montague Wilson, 19, and Demetrius Moore, 18, both of Birmingham - were charged with a theft of a vehicle and held at Jefferson County Jail on $20,000 bond each.

According to police, Mason saw Wilson; Moore; Harold Brown, 20, of Birmingham, and a fourth man whose name was not released in the 5400 block of Park Avenue Southwest trying to jump-start the car that was recently stolen from him.

Sgt. Johnny Williams Jr. said Mason left, got a weapon, came back and opened fire.

Brown was killed and the unidentified man was injured and taken to UAB Hospital. The unidentified man is expected to survive and had not been charged as of Tuesday night, Williams said.
